Psychiatrist
Year-long contract (with potential for extension)
William Beaumont Army Medical Center (WBAMC)
1. GENERAL.
1.1. This contract is for the purpose of providing Psychiatrist services on site and in accordance with the terms and conditions of this contract. The contractor shall provide these services to beneficiaries of the military health care system. Contract Psychiatrist hereafter known as the contract provider shall be of a quality meeting or exceeding currently recognized national standards as established by Joint Commission. All care provided under this contract shall be as comprehensive as government-supplied facilities, equipment and support services permit.
1.2. This is a personal services contract and is intended to create an employer-employee relationship is solely for the provision of healthcare services LAW the contract.. The contract providers performing under this personal services contract are subject to the day-to-day supervision and control by WBAMC facility personnel comparable to that exercised over military and civil service healthcare provider engaged in comparable work. The contract does not create an employer-employee relationship between the Government and any corporation, partnership, business association, or any other party or legal entity with which the individual healthcare provider may be associated. Supervision and control is the process by which the individual healthcare provider receives technical guidance, direction, and approval with regard to tasks within the requirement of this contract. The contractor shall provide a full copy of this performance based statement to all candidates they present to William Beaumont Army Medical Center (WBAMC) before the candidates are presented to WBAMC. Additionally, the intent is to establish a contingency OCO Contract Line Item Number (CLIN) and a contingency CLIN for future growth of WBAMC. The Contingency CLINs will be funded as mission needs dictate to backfill deployed military providers or augment the medical staff for mission related needs,
1.3. Contract providers are serving at WBAMC under a personal services contract entered into under the authority of Section 1091 of Title 19, United States Code. Accordingly, section 1089 of Title 10, United States Code shall apply to personal injury lawsuits filed against the contract provider based on negligent or wrongful acts or omissions incident to performance within the scope of the contract. Contract providers are not required to maintain medical malpractice liability insurance.
1.4. Contract providers shall possess qualifications meeting or exceeding currently recognized national standards as established by the joint Commission. Contract providers shall provide the highest consideration to patient dignity and observe the precepts of the American hospital Association's 'Bill of Rights for patients'. Services provided shall be as comprehensive as Government-supplied facilities, equipment, and support services permit.
1.5. Neither current military nor government civilian personnel shall be employed to perform services under this contract.
1.6. Contract provider is not prohibited, by reason of employment under this contract, from conducting a private practice as long as there is no conflict with the performance of services under this contract
3. QUALIFICATIONS. The contract provider shall:
3.1. Be a Doctor of Medicine or Osteopathy trained in the practice of psychiatry and who has successfully completed an accredited residency in psychiatry.
3.2. Be board certified by the American Board of Psychiatry and Neurology or its equivalent.
3.3. Shall have a minimum of one year of experience (outside of the residency) as a psychiatrist having diagnosed and treated various mental disorders and conditions.
3.4. Possess a current unrestricted license to practice psychiatry and a current Drug Enforcement Administration (DEA) Registration Certificate.
3.5. Have and maintain current certification in Basic Cardiac Life Support (BCLS).
3.6. Be able to read, write and speak English well enough to effectively communicate with all patients and facility staff.
3.7. Possess U.S. citizenship (contractor shall verify copy of birth certificate or naturalization papers). Legal aliens who possess a green card, who are in compliance with U.S. Immigration Laws, and who can provide documented proof of having completed a thorough background check by a United States federal agency may perform these contracted services. No alien who is in violation of the immigration laws of the United States shall be allowed to perform these contracted services. In addition, the government shall not be held liable for not allowing performance under this delivery order by a contract employee who fails to comply with, or maintain, the citizenship of legal alien status requirements stated herein.
3.8. Contract provider performing services under this delivery order will be limited to providing only those services for which he/she holds privileges.
4. DESCRIPTION OF DUTIES/SPECIFIC TASKS:
4.1. The contract provider shall perform all procedures within the scope of a psychiatric specialty. These shall be essentially the same duties as those required of any medical officer or government civil service psychiatrist of similar experience and in similar duty assignments. Other duties shall consist of, but are not limited to, the following:
4.1.1. Evaluate patients for mental, emotional, or behavioral disorders. Obtain adequate history/physical assessment to diagnose various disorders, including the nature and extent of the disorder.
4.1.2. Develop and execute a plan of treatment in a timely and appropriate manner on each patient.
4.1.3. Prescribe medications as appropriate and in accordance with privileges and hospital rules and regulations. 4.1.4. Seek advice of consultants when appropriate or necessary.
4.1.5. Prepare and document appropriate history physical examinations, and diagnosis. Maintain documentation of all treatment provided in accordance with hospital directives and prepare such records and reports as may be required by the policy. Ensure all documentation and reports are legible and complete.
4.1.6. Utilize paraprofessional staff as appropriate.
4.1.7. Respond to cardiopulmonary arrest as appropriate.
4.1.8. Advise the chief of the area where contracted services are being provided of any problems encountered or anticipated in connection with meeting the needs of patients treated. Continuing problems of any nature shall be reported by the contractor in writing to the COR.
4.1.9. Refer all requests for patient/hospital information that cannot be handled by the clinic personnel to the Patient Administration Division (PAD). After normal duty hours, requests should be referred to the Administrative Officer of the Day (AOD) or appropriate authorized personnel. The contractor or contract provider shall not release medical

Information without prior coordination with PAD or the AOD. Contract provider shall abide by all health information privacy laws and policies.
4.1.10. Perform all duties in such a manner that they meet all Joint Commission Standards.
5. ADMINISTRATIVE DUTIES. The contract provider shall;
5.1. Maintain proper medical records on beneficiaries to whom treatment is provided in accordance with Army Regulation 40-66, Medical Record Administration. Medical records completed by the contract provider shall be subject to review by the DCCS, or his designated representative, and a medical records review committee established by the MTF. The contract provider shall be notified of deficiencies in his/her entries into the medical records and shall be instructed to correct the deficiencies. All records generated in the performance of duties under this delivery order will remain the property of, and subject to exclusive control of, the government.
5.2. Use the Composite Health Care System (CHCS), or any other patient information system utilized by the MTF, for keeping records, ordering of ancillary procedures, ordering of medications, writing doctor's order, and performing other required patient record functions at the discretion of the MTF. Contract provider shall receive government provided training on such systems prior to commencing services.
5.3. Not introduce new medical procedures or services without prior coordination with, and written approval of, the MTF Commander, the COP, and the contracting officer.
5.4. Verify the content and correctness of all prepared and transcribed reports by affixing his/her own signature and stamp to all copies of the document and validating its contents.
5.5. Use only those abbreviations as listed in the MTF's official abbreviation book
5.6. Provide and document appropriate history, physical examination, required laboratory and x-ray examinations, and preliminary diagnosis prior to the performance of any healthcare treatment.
5.7. Authorize no referrals to a civilian practitioner when care can be received at the MTF. Contract psychiatrists shall not, while performing services under this delivery order advise, recommend, or suggest to persons eligible to receive medical care at Government expense that such persons should receive care from the contractor at any place other than at the government MTF. Also, contract psychiatrists will not refer patients to any company or service with which they may be directly or indirectly involved (including partnership programs and ancillary services not offered by the MTF.
5.8. Attend and participate in team conferences, professional staff conferences, and other appropriate professional activities as determined by the DCCS, or his designated representative as workload permits during scheduled duty hours. Such participation may include active and full participation in all areas of the Quality Improvement, Risk Management and Utilization Management Programs.
5.9. Attend Continuing Medical Education (CME) courses and maintain specialty specific CME requirements sufficient to satisfy requirements of appropriate licensing agencies and JC at no additional cost to the government.
7. DUTY SCHEDULE.
8.1. Contract provider shall provide services within the WBAMC Mental Health Services 7:30 a.m. to 4:30 p.m. on Monday through Friday excluding federal holidays and command designated training holidays. Hours listed include a one-hour non-paid lunch break. Hours scheduled for shifts do not include travel time involved in reaching the medical treatment facility. The government will only pay for the actual hours worked. Signing in prior to scheduled time will not be considered as hours worked.
8.2. Contract provider will be required to carry a pager when within the MTF or when scheduled to be on-call away from the MTF. On-call duty away from the MTF will occur one week out of every four-week period. Contract provider shall respond within 15 minutes of receiving a page. When on-call away from the MTF, contract provider must be capable of physically being in the MTF within one hour from the time the response to the page occurred.
8.2.1. On-call duty during weeknights will commence at 4:30 pm and continue thru 7:30 am the following morning.
8.2.2. On-call duty during weekends will commence at 4:30 pm on Friday and commence thru 7:30 am the following Monday morning or Tuesday morning if the preceding Monday is a federal holiday. Contract provider shall not be required to be on-call for more than three federal holidays during any twelve month period. Weekend call duty requires the contract provider to perform inpatient rounds on each weekend day that the contract provider is in an on-call status.
8.3. The government reserves the right to verify the hours worked by the contract psychiatrists not only by implementing sign-in/sign-out procedures, but by any other means, including requiring the contract provider to utilize a time clock should one be installed.

Note: Any holidays that are declared by Executive Order shall be observed in the same manner as listed above. If the area in which a contract employee is scheduled to work is closed due to the holiday declared by Executive Order and the employee is not required to report in, payment will not be made for these hours. Closure of installation due to inclement weather or an act of God should be handled in the same manner.
MALPRACTICE LIABILITY
This is a personal services contract for healthcare providers. Contractor employees are subject to supervision and direction of designated Government officials, and will work within the same employer-employee relationship that exists for Government employees. Malpractice allegations against contractor employees based upon performance of this contract will e processed in accordance with Government policy for allegations against its own employees. The Government is a self-insurer for malpractice insurance, and the Government will not reimburse or otherwise pay for such insurance should any be purchased.
